Kenya's employment law landscape continues to evolve rapidly, with several significant amendments and policy changes coming into effect in 2025. Both employers and employees need to be aware of these developments to ensure compliance and protect their rights.

Key Legislative Amendments

The Employment (Amendment) Act introduces several important changes that will affect thousands of Kenyan workers and employers across all sectors.

1. Enhanced Maternity and Paternity Leave

The amended legislation extends maternity leave from three to four months and introduces a mandatory two-week paid paternity leave for all male employees in the formal sector. This represents a landmark step towards gender equity in the workplace.

2. Remote Work Regulations

New provisions now formally recognize remote and hybrid working arrangements, requiring employers to provide written agreements covering working hours, equipment allowances, data privacy obligations, and health and safety responsibilities for home offices.

3. Minimum Wage Adjustments

The Labour Court has approved revised minimum wage rates across all job categories. Employers must update payroll systems to reflect the new rates by the effective date or face penalties under the Labour Institutions Act.
